Nottingham Forest have been unsuccessful in their appeal against their Premier League points deduction.
The East Midlands club were docked four points earlier this season for breach of the league's profit and sustainability rules.
Forest appealed the decision, but an independent commission has decided to uphold the original punishment, the Athletic reports.
The decision means that Nuno Espirito Santo's side remain three points clear of the relegation zone on 29 points.
Luton currently sit on 26 points in the final relegation spot, with Burnley two points further back on 24 points in 19th.
Forest had been handed the initial points deduction earlier this season after they overspent by £34.5 million over a three-year period.
The club initially said they were “extremely dismayed by the tone and content of the Premier League’s submissions” following their deduction, adding they were “also surprised that the Premier League gave no consideration at all to the unique circumstances of the club and its mitigation”.
Forest are next in action on Saturday evening when they host Chelsea at the City Ground. They will secure their Premier League safety if they better Luton's result away at West Ham, although with their superior goal difference they would be all but safe if they match Luton's result.
They then play their final game of the season away at Burnley.
