Critically ill baby Indi Gregory has passed away after her life support was switched off, the charity supporting her family has said.
The eight-month-old was transferred from the Queen's Medical Centre in Nottingham to a hospice yesterday, Sunday 12 November.
Indi was born with a mitochondrial disease, which meant her body could not properly produce energy.
In recent months, she had been at the centre of a legal battle over whether her treatment at Queen's Medical Centre should continue.
Her parents Dean Gregory and Claire Staniforth, from Ilkeston, had wanted specialists to keep treating their daughter, but staff at the hospital said they could do no more for Indi.
In a statement on Monday via Christian Concern, the family confirmed Indi had passed away.
Gregory said: "Indi's life ended at 01.45am.
"Claire and I are angry heartbroken and ashamed. The NHS and the Courts not only took away her chance to live a longer life, but they also took away Indi's dignity to pass away in the family home where she belonged."They did succeed in taking Indi's body and dignity, but they can never take her soul.
"They tried to get rid of Indi without anybody knowing, but we made sure she would be remembered forever. I knew she was special from the day she was born. Claire held her for her final breaths."
The couple lost fights in both the High Court, Court of Appeal and the European Court of Human Rights to continue their daughter's treatment.
Medics said any further treatment Indi received would be futile and cause her pain.
The parents later appealed for Indi to be moved to their Derbyshire home, but this was also rejected by the court who upheld a ruling that her care could only be withdrawn at a hospice or hospital.
A High Court judge concluded that withdrawing treatment at home would be "too dangerous."
