Giuffre alleges that the Duke of York trafficked her to Epstein and Ghislaine Maxwell, where she suffered abuse. The Prince has denied all such claims.
While Kaplan did throw out the technicality, legal experts have said that Andrew could skip the trial by reaching an out-of-court settlement with the 38-year-old.
"I don't think that she has a firm view at this point, nor could she, as to exactly what the resolution should be," Boies told BBC's Newsnight.
"But I think what's going to be important is that this resolution vindicates her and vindicates the claim she's made."
However, the lawyer also said that settlements had not been discussed yet despite initial reaching out to Andrew's team to suggest mediation.

"There was no interest in that at the time," he added. "Whether that has changed or not, I think we'll have to wait and see."
When asked about the US ruling, a spokesperson for Buckingham Palace said: "We would not comment on what is an ongoing legal matter."
This comes as the Duke of York's titles are stripped and his military affiliations revoked. The Queen announced the change in a statement made public on Twitter.
The statement added: "The Duke of York will continue not to undertake any public duties and is defending this case as a private citizen."
